Section 3 of the MOTOR INSURANCE Policy general conditions talks about reasonable care.
“The insured shall take all reasonable steps to safeguard the vehicle insured from loss or damage…”.
What are the reasonable steps to safeguard the vehicle? What may be reasonable to one may not be to another. Is it reasonable to leave the car overnight on the road or in a garage? Anyone would say the latter is reasonable.
By leaving the car overnight roadside the insured did not take reasonable steps to safeguard the vehicle from loss! Hence, claim denied.
In the absence of definition of the phare the validity of claims rejection is questionable. The threat of denial of future claims looms large due to subjective definitions of reasonable steps.
