The Indian law does not have a minimum age for two-wheeler pillion riders.
It is mandatory for the children between nine months and four years to wear a crash helmet and safety harness while pillion riding from 2023. Safety harness is an adjustable lightweight and waterproof vest to be worn by the child weighing up to 30 kg. Both are driver’s responsibility. The speed shall be less than 40 kmph.
Thus, according to MV Act 1988, all pillion riders above the age of nine months must wear a helmet. Insurance policy is liable to pillion rider if there is comprehensive insurance for the two-wheeler. Pillion rider is not 3rd party. Section 128 of the Act specifies that a rider of a motorcycle shall carry one pillion rider.
Safety lies in children’s ability to reach the foot pegs, wearing a correctly-fitted crash helmet and permission from parents.
